According to the agency, the investigation proposes a new law on signals intelligence in war and imminent threat of war, which will provide FRA with the ability to effectively conduct signals intelligence against hostile activities in Sweden under such conditions. Proposals for exceptions from the prohibition on collecting signals within Sweden are also presented, where signals intelligence in specific emergency situations may be allowed if human lives or significant property values are at risk. Additionally, it is proposed that the Inspectorate for Strategic Products should have the right to direct FRA's signals intelligence to map foreign direct investments affecting strategic interests.
Furthermore, it is proposed that FRA should be able to participate in exercise activities to enhance its ability to cooperate with the Armed Forces, with a new provision enabling signals intelligence in live signal environments during exercises. To clarify the legal situation, it is also specified that FRA may collect electronic signals regardless of whether they are stored or in transmission. The proposals will be sent for consultation, and the agency is expected to submit its comments in the autumn of 2024.
Defence Minister Pål Jonson (M) received an interim report from Sjöö on 4 September 2023. The interim report consisted of an analysis of the measures that should be taken to address the deficiencies found by the European Court of Human Rights.
Johan Sjöö was appointed by the government as Deputy Chief of Security Police at the Security Service on 22 November 2012. On 14 December 2016, he was appointed by the government as Chief Judge of Appeal at the Court of Appeal for Skåne and Blekinge.
